Royal Caribbean faces lawsuit from passengers secretly filmed by hidden camera

A passenger on Royal Caribbean’s Symphony of the Seas has filed a class-action lawsuit against the cruise line claiming she was one of up to 960 passengers filmed by a camera hidden in her bathroom.

In September, cabin attendant Arvin Joseph Mirasol was given a 30-year-prison sentence for secretly filming passengers – including children and teenagers. Mirasol allegedly sent images of passengers undressed and ‘engaging in private activities’ to third parties and uploaded them online without consent, according to The Independent.

The US Attorney’s Office in Florida said that, as well as placing cameras in the bathrooms, the 34-year-old had hidden under beds so he could secretly record passengers as they exited the shower.

He was arrested in February 2024 after a female passenger spotted a camera under the sink of her bathroom and reported to ship security. It is alleged he had filmed passengers for up to three months, since joining the ship the previous December, on 12 cruises. Images of up to 960 people were found on his devices, it is alleged.

A lawsuit, under the pseudonym ‘Jane Doe’ and ‘all other similarly situated passengers’, was filed in the Southern District of Florida last Tuesday. It claims the plaintiff suffered ‘severe emotional distress’ and ‘physical sickness’ due to the incident. Her lawyer, Jason Margulies, told Fox News Digital that sexual assaults, including voyeurism, on cruise ships are ‘at an all-time high and need to be addressed’.

The lawsuit alleges that Royal Caribbean ‘should have known sexual assaults were reasonably foreseeable considering the prevalence of sexual assaults on RCCL’s cruise ships’, and that the cruise line should have warned guests, and properly trained staff.

There were 26 sexual assaults and rapes reported during Royal Caribbean cruises in 2023 and 22 sexual assaults reported on its ships in 2022, according to the lawsuit.

A spokesperson for Royal Caribbean told The Independent: “The safety and privacy of our guests is our highest priority, and we have zero tolerance for this behaviour. We immediately reported this case to law enforcement and terminated the crew member. As this is pending litigation, we are unable to comment further at this time.”
